According to Italian law, the ideal solution is a temporary lease, specifically designed for those requiring temporary accommodation, such as those working abroad for a limited period.
What is it?
A temporary lease is a type of rental agreement designed for situations where accommodation is needed for only a limited period, because it is intended to meet temporary needs arising from work-related mobility and related to:
- study,
- apprenticeships and professional training;
- temporary relocation,
- the search for employment opportunities.
To be valid, the contract must specifically state and prove the actual transitional need and be drafted in writing using the official templates provided by the Ministerial Decree of January 16, 2017.
Unlike ordinary rental contracts, which have a minimum term of four years, the transitional contract can last from 30 days to 18 months.
Unless otherwise agreed, the tenant may terminate the contract only for serious reasons.
Rent
The rent can be freely agreed between the landlord and tenant, unless they choose to follow local agreements between landlords' and tenants' associations. This may occur in Italian cities with more than 10,000 inhabitants, where local agreements would determine rent ranges based on the location and characteristics of the leased property, within which the parties agree on the rent for their specific case.
The tenant must also contribute to condominium fees, if applicable.
Written Form and Registration
The contract must be in writing and registered with the Revenue Agency within 30 days.
